Case: Wanda Maximoff is a refugee from the nation of Sokovia. Wanda was granted asylum status in the UAE but applied for and eventually received permanent residency in the United States. Wanda does not know why she was granted permanent residency so easily (as compared to many others) in the US. Unknown to Wanda, the US government was made aware of special abilities that Wanda possessed that made her have superpowers, including flying, mind control, and the ability to create large impassible physical barriers with her mind. The US government is aware of this, while Wanda is not, because her powers derive from secret experiments done on her by the former Sokovian government when she was a child. The US government found the information out through one of the Sokovian scientists, who had experimented on Wanda and then subsequently defected to the United States. The scientist now works in a top-secret US government lab. The US government granted Wanda permanent residency so that they could keep an eye on her and her superpowers, without letting her know that she has such powers. Upon arriving in the United States, Wanda moved to Westview, a small town in the US state of New Jersey. She rents a small house in town and found a job in Westview bagging groceries at the local supermarket. On August 1, Wanda has an hour until the end of her shift when a man approaches the checkout clerk with a gun. Without thinking, Wanda wraps herself and the clerk in a protective bubble. The man with the gun begins to shoot at the bubble, but the bullet gets stopped by the bubble and falls harmlessly to the ground. The man realizes that the gun will not do anything. so he decides to steal five bags of Doritos and three packs of gum from the checkout aisle before running out of the store. When the man leaves, Wanda is unable to lower the protective shield for 30 minutes, and the checkout clerk hyperventilates and passes out. Once the protective shield is raised, she is quickly revived by paramedics with no lasting damage. On August 2, after a long night's sleep, US government officials arrive at Wanda's house to explain her powers to her and why she has them. They bring doctors and scientists with them to conduct tests on Wanda Wanda refuses, the government officials insist, and, when they try to force her to undergo the tests, Wanda (again unintentionally) surrounds herself in a protective bubble and flies in it out of her home, destroying the ceiling of the first floor, the floor of the second floor, and the roof of the house in the process Wanda decides to fly all the way back to the UAE in her bubble. Once there, she is exhausted by the energy it took to maintain the bubble and to fly, and she promptly passes out on arrival. When she wakes up two weeks later, she is in a hospital in the UAE and explains everything that has happened to the nurse while a bystander films the entire conversation. Baffled by what she has said, the bystander posts the video to YouTube Wanda's boss, Henrik, sees the video. In addition to the events in the store, and the fact that she had missed two weeks of scheduled shifts, he decides to fire Wanda. The next day, Wanda returns to Westview for her regularly scheduled shift and finds out that she was fired. Questions: 1. Is Wanda guilty of any crimes? Explain. (30 points) 2.
