Chad has been working for Apple in Australia and wishes to leave and Join Vodafone. He originally entered a contract that had a clause that said he could not work for a competitor in the same city for a period of 12 months. Chad did not read his contract when he entered it. Please advise Chad a)What would the court take into account in determining whether the term was enforceable? b)If Chad had received legal advice regarding his contract would that alter your answer. c)If Chad went to work for a movie production company in a completely different capacity could Apple enforce the clause.
