Charlie owns "Charlie's Good Time Bar." He likes to treat his customers very well and they have made his business very profitable. Charlie's chief bartender is Ben. One night Ben comes to Charlie and says "I've got a customer who is really drunk already and wants me to continue to serve him." State law prohibits a bar from "over serving" customers and bar owners and employees can be held liable for any harms that occur if they continue to serve someone who is already obviously intoxicated. Charlie sees that the customer is Leo, one of his regulars. Charlie tells Ben, "Leo is one of our best customers. I order you to keep serving him all that he wants." Ben does so and Leo really becomes hammered. Leo eventually leaves (extremely drunk) and drives his car through a red light striking another vehicle. Two people are killed. Leo has a BA rating of 3.66 when he is arrested. Later Charlie is indicted for Manslaughter as a result of Leo's drunk driving and the resulting deaths. Charlie claims he had nothing to do with this since he did not personally serve Leo and was certainly not driving the car that caused the deaths.
