Cherry Kolah, age 16, signed a contract to buy a Camaro from Michelle Lynn Motors.Cherry is the daughter of a very well known local businessman, R.C. Kolah. The Kolah family lived about six miles from the dealership. The Kolah family was friends with the Lynn family.Cherry lived about six miles from her school and about one mile from her job and used the Camaro to go back and forth to school and to work. Cherry misrepresented her age by using a false ID card which was an obvious fraud. The photo looked nothing like her rather it was a photo of Liz Onya, the owner of a local Italian restaurant.
When Cherry did not have the car, she used a car pool to get to school and to work.Cherry's father drove in the car pool as did several other parents.Several months later, the used car became inoperable due to a blown head gasket. That diagnosis was made by Max E Mumm who was a local mechanic who had also done time in prison for fraud and embezzlement. Once the bill was presented to RC from Max, RC became aware of the car. Hegave notice of his rejection of the bill and told Max to get lost. The work had already been done and the bill was for 750.00.
Michelle Lynn Motors had purchased this vehicle at auction for $1,500.00.The sale price to Cherry was $9,000.00.
Please discuss all the issues contained within this case. For example, was ther a contract between Cherry and the dealership? Why or why not? Do the parents of the child have any rights? What rights or remedies are there? What about the repair shop? Was there a contract? What rights do all of the parties have?
