This week, we have discussed the various defenses to negligence. They are contributory negligence, comparative negligence - pure, modified comparative fault - 50% rule and modified comparative fault - 51% rule. If you were a legislator, which of these defenses would you choose to adopt? Explain your reasoning for your choice. (5-6 sentences)

The classmate response is below:

"I would choose to adopt the modified comparative fault 50% rule. I think if someone has just as much fault in a situation, you should not receive compensation. I think if you had the opportunity to prevent an injury and still chose not to, you should not be able to recover anything out of it. I know it's not always foreseeable, but if it is then you should try to prevent it as much as possible."
