Colin an employee of Jammin Sports Inc. was driving his truck along a busy road on his way to a windsurfing competition at a nearby river, where he was asked by his employer to display their products. Suddenly the windsurfing board that he had secured to the roof of his truck flew off into the traffic behind him. Donna was driving behind Colin and swerved to avoid the windsurfing board, hitting Wade, who was cycling. Wade was not wearing a helmet. Observers stated that Donna was speeding.Jammin Sports Inc. says that it had provided Colin's truck with a proper rack which should have made the board very secure, and that Colin must have ignored their instructions regarding attachment of the board. As a result of the accident, Wade suffered a broken arm and leg as well as facial injuries and his $4000 bike was severely damaged.
