The Judge has some flexibility and stands above and sets the rules to guide future rulings. The rule for common law countries may not always follow a constitution or a code of law. The disadvantage of common law is the perpetuation of bad decisions. It is Complicated because the decision of the court are binding only in a particular jurisdiction and even within given jurisdictions, come court have more power than others. the drawback is that once a decision has been made there is no change and the same decision is followed again.

Civil law countire judges are the main investigator and they advise the client with legal proceedings. Civil law is a constitution based on a code of law and codes apply to specific areas. Civil law can leave room for much debate. Another concern viewed as a disadvantage of the civil law code is the lack of jury trials.
