Jenny Jones, a 30-year-old citizen of Canada, comes to see you in your office. During the meeting she tells you:
- She is currently in Australia as the holder of a working holiday visa which will expire in one month.
- She found a job as an administration assistant in an accounting firm, and they would like to 'sponsor' her.
You check the regulations for the subclass 482 visa and advise that for a number of reasons (administration assistant is not on the relevant skilled occupation lists and she does not have the required amount of employment experience) she is not eligible to be sponsored. There are no other visa options for her. She tells you that she really wants to stay because Australia is a much safer place to be during the COVID-19 pandemic and she would not earn half as much money working as an admin assistant in Canada.
She asks for your assistance in lodging a subclass 482 application anyway. She explains that once this is refused, she will 'appeal' the decision and the lengthy wait time at the Tribunal will give her enough time to find an Australian boyfriend and lodge a partner visa.
