Community Correction:

Separate Questions

1. In relation to the early termination of community supervision, do you feel that it should be granted primarily based on good behavior, or should offenders serve their entire sentence, regardless of good behavior? Explain what might be the advantages and disadvantages of each approach? Discuss the consequences of the disadvantages, both near and far reaching,on the offender, the community, the courts, and correctional system.

2. Case study

Johnny Jackson is a 32 Y/O white male. He also has a BA degree in Finance. He served 5 years in jail for vehicular manslaughter. He was out at his employer's Christmas Party and had been drinking. While driving home, his tire blew out and he crashed into another vehicle, killing the driver. Johnny received a split sentence, where he served time in jail and was released on Parole. Johnny served a year of his parole with no issues. He has been discharged from Parole and is now on Probation with you. The Special Conditions of probation are: 1. Not to drive a vehicle unless properly licensed and registered. 2. Substance Abuse Evaluation, and Treatment (if recommended). 3. Secure employment. 4. Perform 100 hours of community service. Overall, Johnny has been doing well. Last week, you take an unscheduled urine sample in which he tests positive for marijuana, a technical violation (he resides in a state where it is not legalized). You make a recommendation for treatment. Johnny has been attending, but last week he missed two consecutive appointments. Then, you receive a notice that he was stopped and received a citation for operation of a motor vehicle while his license is suspended.

How you would proceed: modification, retention under supervision, or revocation and return to jail. Choose one response and fully justify your decision.
