Constitutional Issues During Covid-19 In May, New Jersey prisons had the largest number of Covid-19 deaths in the country. At least 42 inmates and 3 prison employees had died. 89 % of inmates and employees tested positive. On April 10th, Governor Murphy signed Executive Order 124, which allowed for the release of high-risk inmates whose sentences were to expire within three months. But, of the 3,000 state prison inmates qualified, only approximately 100 were initially released. (The Star-Ledger, May 17, 2020). The related constitutional issue was, did keeping nonviolent prisoners in jail without adequate protection a violation of the Eighth Amendment.
