On June 30, 2017, Valentin and Valentina Weiss ("Weisses"), sold a 2008 Honda Odyssey Touring van, "as is" with 165,769 kilometres, to Kamal Al Hassan for $9,200. The Weisses' vehicle registration was provided to Mr. Hassan. It stated that the vehicle was "rebuilt" with an odometer reading of 78,485 kilometres on August 29, 2013.

On June 20, 2017, the Weisses had Terry's Towing do a statutorily mandated safety inspection. The vehicle passed inspection.

The Odyssey was vandalized on April 2, 2018. When Hassan took the Odyssey to MPI, structural deficiencies in the frame were identified. As a result of the deficiencies, MPI suspended the insurance and registration.Hassan could not drive the Odyssey until the structural deficiencies of the frame were fixed, and MPI registered/insured the vehicle.

Hassan believes the vehicle was not safe when he purchased it from the Weisses. He wants $10,000 to repair the vehicle.
