Contract Law exercise 1. Aspiring teenage musician Kayla Swiftie comes to Nashville and hangs out on the Broadway strip her first weekend here. She falls in love with the city, the music vibe, and feels her music skills are pretty good when she sees the talent in town. 2. Swiftie meets numerous bouncers and managers of bars, and a few tell her in conversation they will let her sing in their bar (Bar One, The Stage Left, Tonky Honky) while a few others have advertisements saying looking for musicians to sing tomorrow (Bar Tooties, Tonky Honky, Vodka Cowboy). Swiftie say "sure" to everyone 4. Swiftie shows up the next evening ready to sing and tells each of them when she enters their respective bars that she expects $50 for the gig. 5. The first manager at Bar One says get out of here. 6. The second manager at Tooties who had an advertisement out says sorry not taking singers tonight. 7. The third manager at The Stage Left says come back next week one day before we open and we will listen to you - that is all we agreed to. The fourth manager at Tonky Honky puts her up on stage immediately and passes the tip jar as is custom and at the end of the night gives her the tips and nothing more. 9. The fifth manager at Vodka Cowboy puts a contract in front of her to sign that says $20 per performance. 10. What does Swiftie and the various bars do next? a. Is there an offer? b. Is there acceptance? c. Is there consideration? d. Are the terms clear, indefinite, vague, or other? e. Is any agreement legal, illegal, unconscionable, lacking capacity, impractical, or other? f. Is there an agreement that is enforceable? g. If there is an agreement, did anyone breach? h. If so, are there damages? Could specific performance be required? You may do this assignment individually or in groups of 2 to 4. Think about each situation, talk in your groups, and write an analysis for each scenario with a conclusion of whether a contract exists or not.
