CONTRACT LAW:
Please Answer these questions as detailed as possible
13. Charlie induces Adam to buy a 1611 map of Middlesex from him upon Charlie's representation, made in good faith, that the colouring was original. In fact, the map was coloured a century later. In an action by Adam against Charlie for damages, Charlie serves a defence admitting that his representation was untrue but asserting that it was made in good faith. At the trial, Adam is unable to produce evidence to controvert this assertion. What are Adams rights?
14. In the following situations suggest how the rule from the Boots Pharmaceuticals case above would operate and whether a contract has been formed or not:
a. An eight-year-old boy, Andy, has gone into an off license, selected a litre bottle of rum from the shelf and taken it to the counter. The sales assistant, Brenda, has told him that she cannot serve him because he is under the age of eighteen.
b. A customer, Connie, has been wheeling her shopping trolley through Madsavings Supermarket. She has picked up several items and when she has found a different brand of the same product which is cheaper further down the aisle she has selected that product and abandoned the one she had earlier picked but in the wrong place. This has now happened with seven different items and the manager, Dave, is very annoyed that Connie is causing his staff extra work and tells Connie that she has to buy all of the items that she has selected and then put down again.
