CRIMINAL COURTS GROUP PORTFOLIO ONE SUBMISSION BY EACH GROUP LEADER ONLY General Directions: Your answer should be typed in times new roman 12 point font, double spaced with one inch margins, and include APA intext citation of the sources from your book readings (including both your American Courts & The Criminal Justice System text as well as your Arkansas Criminal Law Manual where appropriate. You also must include a reference page of all complete source citations. I am not giving you a page limit, but your goal is to show me you have completed the assigned readings, lectures, articles, videos, and other content from this course, and are able to apply this material. You should include the section headers in your text to designated the various stages of the process. Following these directions, address the following: I, Sherry Skaggs, am very scared. At gunpoint, I forced Ed Powers into his vehicle outside of Irby, and forced him to drive to Toad Suck park. I then shot and killed him, I dismembered the body with assistance from Mary Crawford, and we disposed of the pieces in the Arkansas River. I do not know anything about the criminal court process, and I would really like some help understanding all of my charges, the proceedings that will be occurring, my plea options, as well as the general timeline for these proceedings as described by law. In this section, you should clearly cite the Arkansas Criminal & Traffic Law Manual. Section 2: Understanding the Courts & Their Players. What is the courtroom workgroup? Discuss the roles of all individuals included in the courtroom work group? What does an adversary process mean? What can I expect when I enter the courtroom? Section 3: Elements of a Crime & Burden of Proof. First, what are the elements of a crime (discuss each)? Explain how each pertain to this case. Second, what are the various burdens of proof? First, illustrate all of them in a diagram from lowest (at the bottom) to highest (at the top). Then, explain each and discuss its applicability or lack of applicability to each part of this case? Section 4: Defenses, Rights & Pleas. What are the categories of defenses (explain each)? What are the available please across the country (explain each)? What are the various pleas available in Arkansas (explain each)? What are the rights afforded to the defendant (utilize both the U.S. Constitution as well as the Arkansas Constitution (and cite each for this). Explain each of these constitutional rights. Section 5: The Criminal Court Diagram. I am a visual person, so I would like a big chart that includes each stage of the process, each possible plea, and the stage(s) of the process following that plea. In the trial section of this, make sure you diagram each stage of the trial process. You may not directly copy or plagiarize charts from other sources. You must build your own complete chart showcasing each step and including what the next step would be if I entered X plea, etc. Section 6: Criminal Court Process. Please explain the entire criminal court process from what happens immediately following my arrest until sentencing. This is where you are really explaining your chart from the previous section. Make sure you really explain each of these steps as I do not understand anything about the legal system or the purpose of these steps. Include the purpose of each of these steps.
