CRIMINAL LAW

Hugly, distraught that his ex-girlfriend Yove broke up with him, decides to go talk to her. Knowing that she might not want to talk to him, he climbs into her window and waits. When she returns, he pulls her into her room. He takes her cell phone and disconnects the land-line, standing between her and the door when she tries to leave. The two argue, becoming more and more upset, until at some point Yove tells Hugly that she is in love with someone else, and laughs at Hugly. Hugly flies into a rage and begins to strangle Yove to stop her mocking laughter. She is choked until she stops moving or responding, at which point Hugly, now frightened instead of angry, flees.

As he exits her dorm room, he sees Yove's neighbor Jorge standing outside. "I heard you guys fighting," Jorge says, seeing Hugly's terrified expression. "I know your parents are rich. Give me $25,000 or I'll turn you into the police and tell them all I know."

Hugly agrees, telling Jorge that he would get the cash and return the next day with it. Jorge tells him to leave through Jorge's room and exit his window so as to avoid the security camera in the front entrance of the dorm. After Hugly leaves, Jorge breaks into Yove's room and steals her laptop and some loose cash, without touching either Yove or anything else. Yove, unattended in the room, later falls into a coma and dies.

With what, if anything, can Hugly and Jorge be charged and convicted?
