Criminal prosecutions for violations of OSHA regulations can only result in a misdemeanor conviction with a maximum sentence of 6 months in prison. An employer can only be criminally prosecuted if a willful violation results in the death of an employee.

NOTE:OSHA does not conduct criminal prosecutions.Once the finding of a Willful Violation of an OSHA Standard (which resulted in a death) is final, OSHA must refer the case to the local federal prosecutor. It is the prosecutor that decides whether or not to take up the case.
