Maggie owns a 70-inch monitor for her desktop which she had bought five years ago and the warranty on it has expired. Recently, the monitor was not functioning properly and finally, it was not working at all. Maggie decided to take it to an electrician. She took it to Topps Electronics which was located at Meppati Road. She handed the monitor at the customer service counter. The customer service officer handed a receipt which contained the collection date written on the front of the receipt. On the back of the receipt the following statement (exclusion clause) was printed: IMPORTANT The owners and management accept no responsibility for any loss or damage suffered by a person who uses its repair services, regardless how such loss or damage is caused, whether by any act, omission, negligence or otherwise on the part of the owners, management or their employees and agents. Since this statement was printed behind the receipt, she did not read the notice. Maggie returned to Topps Electronics to collect her monitor, to her horror there was a hole, cracked screen and many burn marks on the back cover of the monitor. She approached the Customer Service Manager for an explanation. The manager pointed to the exclusion clause behind the receipt and claimed that they were not liable for any damages.
