Dani instructed his agent, Aslam, to sell his semi detached house at Paya Rumput at

price of not less than RM230,000. Aslam also was requested to inform Dani of the

particulars of potential buyers first before entering into a contract. In retum, Dani agreed

to pay 5% as commission to Aslam. There were two interested buyers, one was a friend

of Aslam, Mr Shim, who agreed to purchase at a price of RM230,000 and another buyer

was Mr Harris who agreed to pay RM235,000. Aslam did not inform Dani of these two

potential buyers and made his own decision to sell the house to his friend. After the

completion of the transaction, Dani discovered the true story. He discovered that Aslam

has received RM2,000 from Mr Shim. Dani was upset and refused to pay Aslam and

wished to take legal action against Aslam. Advise Dani.
