David, a resident of Portage, Michigan, was arrested for failure to pay child support (an obligation imposed by the State of Michigan and its courts). He was taken to jail in Grand Rapids. After a few hours, a deputy sheriff from the county jail took David to appear before a state court judge (Judge Sally). After a 27 minute hearing, Judge Sally stated orally from the bench what she had decided to do with David's case. David understood what Judge Sally was saying to mean that he was to be immediately released. After the hearing, however, the deputy sheriff took David back to the county jail where he spent the night. The next morning Judge Sally signed a written order for David's release and faxed it to the jail. Within 32 minutes after the jail received the faxed order, David was released. David, however, was unhappy that he had been required to spend the night in jail and believes he should have been immediately released from the courthouse following his hearing before Judge Sally.
