Dee Saw Mill Company operates a sawmill on a land belonging to Josefa Embares. On the land, the sawmill erected a building which housed the machinery used by the company. Machines of the company were also placed and mounted on foundations of cement in the building. In an action for collection of sum of money, a judgment was rendered against Dee Saw Mill Company and a writ of execution was issued and the machineries were levied upon as personalty by the sheriff. The Company questioned the levy claiming that the machineries are not personal property but are real property as it is intended by the Company for use in connection with the business carried on in the building.
