Denise tells Don she wants to purchase his 1973 Volkswagen Beetle. Don says he can't take less than $3,000 for the car. Denise says she only has $2,500. Don says he could do $2,750. Denise says she will think about it overnight and let him know. The two agree to meet the next day for lunch. Denise goes to the library to study for her business law test and accidently leaves her phone there overnight and it loses its charge. Meanwhile, driving home that night a special old song comes on the radio and Don thinks about girl he used to date who left him in Boston to go to college in California. He recently saw that she posted an old picture of them on Instagram with the caption - "Sometimes you realize who really matters too late." Don texts Denise at 5 am saying, "Can't sell the car, gone to see a girl." And takes off to find his true love in California. At 5:30 am, Denise awakes in a cold sweat and flails around searching her covers for her phone before realizing she left it at the library. Terrified of oversleeping, she asks her roommate to wake her up at 8 am. She also borrows the roommate's phone and texts Don that she wants to buy the car for $2,750. DiscussANY potentialoffers, counter offers, acceptances and revocations you see here and whether you think a contract was formed. Tell me the rule of law - the definition of the rule and apply the facts to the rule. Write in paragraph - not a list. State all of the elements and rules and apply the facts to the rules. Even if you think and offer, acceptance etc. was not valid - discuss it as a potential offer etc. Who will prevail?
