He went to Fi-Var Park Homes Corporation, owned by two old Business Law classmates--Kory Fishbein and Matthew Perry--and signed a contract to buy a house from Fi-Var. To landscape his new property, Galinski made a contract with Rebecca Thamm to plant shrubbery on the lot. Thamm planted the bushes shortly thereafter.
Unfortunately, Galinski, celebrating his new home, overate and overdrank, and suddenly dropped dead. Feeling sorry for his heirs, his old friends Fishbein and Perry, on behalf of Fi-Var Park Corp., canceled the contract for the new home and took back possession and ownership of the property (with the shrubs on it).
On learning this, Thamm sued Fi-Var Corp., for the amount due for the shrubbery.
