Describe the law of search and seizure in Canada, and with respect to searches within correctional institutions. In doing so, be sure to discuss the following:

• Section 8 of the Charter
• exclusion of evidence in the event of a Charter breach
• factors used by the courts in reaching the decision of whether to include or exclude evidence obtained by an unreasonable search
• the types of searches and the grounds and authorization needed for them under the C.C.R.A
