Article 4 Grievance Procedure

Complaint Stage (New): Before initiating the formal grievance process, employees are encouraged to engage in a "complaint stage." During this stage, affected employees can discuss their concerns with their immediate supervisor in an attempt to resolve the matter informally. The supervisor should actively listen, address the issue, and work collaboratively with the employee to find a satisfactory resolution.

Step One: If the issue remains unresolved after the complaint stage, the matter will proceed to step one. Within 14 calendar days, the steward who attended to the complaint and the chief steward, along with representatives of management for the functional area, will convene to review the grievance. The grievor may choose to be present during this stage. The HRM manager or her designate may also attend if necessary. The organization will provide a written decision within 5 working days.

Step Two:Failing settlement under step one, the matter will be taken to step two. Within 14 calendar days, the steward who attended to step 1 and the chief steward, together with representatives of management for the functional area, will meet to review the grievance. The grievor may choose to be present at this stage of the procedure along with the HRM manager. The written decision of the organization shall be returned to the Union within 5 working days.

At this stage, the grievor shall also have the the right to directly present the facts of the case. While Management contends that the union should solely represent the employee, exceptions may be considered for cases involving discharge.

Step Three: Failing settlement under step two, the matter will be taken to step three. The Union designates shall be the business agent and the Union local president. The organization's designates shall be senior management representative for the functional area, or their designate, and the HRM manager. The grievance may be resolved by agreement and the decision shall be final and binding. This meeting must be conducted within 15 working days and the grievor and his steward shall be present and will not suffer any loss of wages.

Article 15- Hours of Work and Overtime

15.07 -Where an employee challenges the organization's assessment of workload on a route,reassessment shall be conducted jointly by management and a union representative. If needed the driver involved will perform the route on another day within the same week to facilitate the reassessment.
