Dina was invited to attend a Saturday afternoon birthday party at Cafe, a local restaurant. When she arrived at the Caf on the day of the party she found Cafe's main parking lot was full. A Cafe employee directed her to park several blocks down the street in another parking lot. The second lot was owned by Cafe but, unlike the main parking lot, had no attendant. Dina parked her car in the second parking lot down the street, and rushed to the Cafe, forgetting to lock her car. While Dina was at the party, Kyle, age 12, walked into the parking lot. After trying the doors of several locked vehicles, he entered Dina's unlocked car. Kyle found a spare set of keys to the vehicle in the glove box where Dina had left them. He started up the engine and exited the parking lot. Kyle had trouble controlling the car. Three blocks after exiting the lot Kyle slammed on the brakes to avoid hitting a child (Vickie). Unfortunately, he struck and injured Vickie, age 2, who had ran into the street from between two parked cars. Sitter, Vickie's babysitter, heard Kyle suddenly brake from inside the house. When Sitter looked out the window she saw Kyle's car hit Vickie. As a result of witnessing the accident, Sitter has experienced periodic metal depression and difficulty sleeping. 1. What are Vickie's rights against Kyle? Against Dina? Against Cafe? Discuss. 2. What are Sitter's rights against Kyle? Discuss
