Directions: Read and answer the question below. The Assignment is due on February 6, before class. Your answers should be in paragraph form and in Arial, 11 point font. Your answer should be between 750 and 1000 words. Any assignment received past 3 p.m. eastern standard time on February 6, 2024, will be considered late and will receive a 20% late penalty. I will not accept assignments that are more than one week late, without appropriate written support, such as a medical note that would explain an illness of at least two weeks duration, prior to the due date for this assignment. Please note the following: This is an individual assignment. Be sure to include your name on the assignment itself. I print out the assignments to mark them. As such, I try to conserve on paper. Please use single spacing and avoid fancy cover pages. You must read and refer to the cases that are included with this assignment. You should also refer to your text in your answers. Please refer to the Rubric for this assignment for more details about how to write this assignment and to see how your mark will be affected by the use of resources. If you do not use any resources or you do not use the resources referred to in this assignment, you will automatically receive a failing grade on this assignment. Class power point presentations are not an acceptable resource. If you wish to use a resource other than those referred to in this assignment, you must obtain my approval, first. To be clear, if you do not have my approval and you use a resource other than the ones referred to, you will automatically fail the assignment. If you spot an issue that we have not spoken about in class, you may choose to write about it, but you are not expected to write about it and you will not receive additional marks for doing so. In other words, focus on the primary issue or issues in the fact pattern. Question Mr. Apple, an experienced skier, decided to take a short skiing trip. He went to Snowy Hills Ski Resort, where he was to ski for three days. On the first day, February 10, 2022, Mr. Apple noticed that there was ice on the chair as it approached him on the chairlift. He tried to clear the ice off of the moving chair and was so focussed on this task that he didn't get himself seated in time. As such, he instinctively grabbed onto the moving chair. As the chair continued to move and ascend, he quickly realized that he would not be able to get seated on the chair and would therefore have to let go and drop to the ground to avoid a severe injury. He let go, and fell to the ground, dropping about three metres, and he injured his right shoulder. He subsequently sued due to the injury he suffered. Explain what Mr. Apple will have to demonstrate to prove his claim. What arguments could the defendant make? You are the judge. Make a decision and explain how you reached your decision
