Hello Class,
The issue that's presented in the article that I've chosen was a Dallas, Texas coffee company terminating two employees with disabilities who asked for reasonable accommodations. This an illegal act according to the Texas Labor Code Chapter 21 (Chapter 21) and the Americans with Disabilities Act ( ADA ).In my opinion, it's completely unethical and unfair treatment and should never be done in any circumstance.

Coffee Company Fired Two Employees with Disabilities Who Requested Reasonable Accommodation. DALLAS - North Richland Hills, Texas-based 151 Coffee will pay $70,000 and furnish other relief to settle a disability discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission(EEOC, 2022).

The Americans with Disabilities Act of 1990, also known as the ADA (42 U.S.C. 12101), is a civil rights statute that outlaws disability discrimination. It provides Americans with disabilities with comparable anti-discrimination protections as the Civil Rights Act of 1964, which made discrimination based on race, religion, gender, national origin, and other characteristics illegal, as well as later sexual orientation and gender identity. Furthermore, unlike the Civil Rights Act, the ADA requires covered firms to make reasonable accommodations for disabled employees and imposes accessibility requirements on public places.

The defendant was accused of a Multi-Year Embezzlement Scheme To Defraud Alameda-Based Labor Union, their former employer. He "abused his authority as the IT director of the Operating Engineers Local 3 by creating a complex scheme to steal millions of dollars in union funds"(2021). This was done by creating a front company to conceal the payments that were being made.

Theft consists of intent to take property, usage of property, and not having authorization to mess with property. It then becomes embezzlement when " the person commits the crime while in the employ or position of trust of the property owner" (Jennings, 2018). Between 2011 and 2017 while employed at the union, Wilson fraudulently misdirected at least $3.98 million to the front companies he made by creating fraudulent invoices by the union for IT-related goods and services that were never to be delivered.(2021)

Schemes like this can be more disruptive beyond the business simply losing assets. Trust between employers and their employees is very important. Then you have to make sure you are kind , in order to stay on their "good side", to keep from prompting them to want to steal and lash out against the business. Even when it comes to doing background checks, there is no real way to determine a person's capabilities when or if put in a situation or when given the opportunity.
