When she tried to ush the toilet, the water (and associated waste products) backed up and overowed. In a few moments the water covered her bathroom oor and seeped into her bedroom covering the carpet. In addition to the watery condition, the waste created an awful smell throughout the house. Daisy called a local plumber but they were too busy to help. Just then, Daisy noticed a plumbing truck parked in front of her neighbor's home. She ran next door, described her problem to the plumber and asked if he could help. "You bet. I've been a plumber for 15 years and have extensive experience with household plumbing. Would you like me to come now? I've nished this job for your neighbor and so am free for a little while". "Yes, please" responded Daisy in exasperation. "By the way, my name is Jake. I own Jake's plumbing. Let's go take a look". Daisy led Jake back to her home. Jake inspected the area and told Daisy, "It's a pretty easy x. I turned off the water to stop any more leakage. I'll need to replace the pipes going into the bathroom. You'll also need a new toilet and the carpeting will have to be replaced". "How much" asked Daisy. Jake responded - "I can do the whole job for $15,000. Half up front and half on completion". Daisy agreed, and wrote Jake a check for $7,500.00. Jake completed a contract and both he and Daisy signed it. Jake then left promising to retrieve the materials he needed and to return by tomorrow. First thing next morning, Jake returned with a crew of workers. By the end of the day, everything was done. Daisy then paid Jake the remaining $7,500. Daisy thanked Jake for being quick and efcient. Unfortunately, Daisy started having more plumbing problems. Over the next few days, the situation grew worse. The "new" toilet started to back up and soon the water (and waste) went everywhere. Daisy called Jake but discovered his phone number had been disconnected. It was then she realized that she had been cheated. After making several calls to various state agencies, Daisy discovered that Jake was a new plumber with very little experience and that he also failed to pass the licensing exam required by the state in which Daisy and Jake reside. Daisy spoke to her attorney who quickly led suit based on fraudulent inducement. To win, Daisy must prove that Jake committed fraud. Daisy will have to prove the ve elements of fraud.
