Many legal experts believe our Supreme Court confirmation process is utterly broken. Nearly three decades ago then Professor (and now Justice) Elena Kagan described the process as a "hollow charade."

Most Supreme Court nominees refuse to answer any questions during the hearing that could jeopardize their opportunity to join the nation's highest court.

Often the hearing itself is more about political grandstanding than ascertaining the

qualifications and judicial philosophy of the nominee.

This week Judge Jackson appeared before the Senate Judiciary Committee

prompting debate once again on how nominees should be treated during the confirmation process.
