Discussion : When Privacy, Technology and People Collide

Privacy interests can be broken down into two larger areas of interest: 1) data privacy and 2) personal privacy. However, often these areas overlap. For example, if someone has a watch that acts as a wearable health data tracker then they may have privacy issues that arise based on their "data" and on "their personal sense of privacy". There are also two major areas of law implicated when we talk about privacy: 1) 4th Amendment and law enforcement use of dat and/or personal info, and 2) other misuse of that data that doesn't involve criminal investigation. Remember from your reading that SCOTUS has clearly stated people have a "reasonable expectation of privacy against governmental intrusion"--which means we have a standard here for what rights we have to push back against data and personal info gathering done by police or other law enforcement for purposes of use against us in a criminal case. However, we also have a general Constitutional right as many scholars have noticed that is tied to concepts like our "right to pursuit of happiness" and our "right to freely assemble". So,for this discussion we want to focus on two things: 1) how do you see the difference between data privacy and personal privacy? What defines each idea? Are the actually very similar the way we use today's technology and access that information? Based on my lecture on privacy interests what tech do you see out there that raises issues of privacy? What can you find about how that data might be regulated or controlled? Is it really protected? Are we? And if not what policies or laws might you suggest to do better? You may use some examples and link stories from the news as part of your replies here just be sure to tell us briefly what the story is about.
