Disparate Impact Disparate Treatment is when employees are treated differently due to Sex, disability, race etc. and are treated differently on purpose with no regard to the relationship of the job. Disparate Impact is when an employer's practices affect a group or groups of employees unintentionally and in a nondiscriminatory way that leads to the group being underrepresented in employment decisions. The rate are which women failed the assessment at a higher rate was due to not being able to lift one hundred pounds which in this job is a related skill one must be required to perform for the safety of everyone involved. Thinking about the hiring process does not mean that because these individuals may not be able to perform this job that they would not bring value to the organization. As Human Resource managers, we are responsible for assessing talent and seeing if there are opportunities in the company where their talents may be compatible. We use our hiring practices to not only find the best candidate for the job but also to ensure that the company and its assets (including employees) are safe and protected.
