"...I do not think class action lawsuits should be restricted. Class action lawsuits are a great way for big businesses to be held accountable; something we desperately need in our capitalistic society. If certain parties have been damaged such as consumers, there should be repercussions for the entity that caused the harm to begin with. In many cases this is seen in "consumer protection, environmental, antitrust, and securities fraud litigation (Banks and O'Brien 387)". With individual consumers, for example, being damaged from a harmful product, they can band together and take part in the class action lawsuit. This means that all parties will have representation but they are not paying an arm and a leg to get it. The threat of a class action lawsuit not only protects those who are damaged, but it deters organizations from partaking in fraud and unfair business practice. With all of the strength that class action lawsuits have, there are also some weaknesses. One weakness is political controversy as some class action lawsuits end up being "mass tort actions". Another is that as a result of class action lawsuits, there are many "logistical management problems for lawyers, clients, and the judiciary (Banks and O'Brien 388)". As much as we don't want to overburden our judiciary, I still contend that class action lawsuits are a positive thing. The American people deserve representation, and with how expensive it can be from a civil standpoint, these class action lawsuits are a necessity...."
