DOJ's guidelines in Accessible Stadiums, states that "[w]heel chair seating must be dispersed throughout all seating areas and provide a choice of admission prices and views comparable to those for the general public." In Landis, the question was whether the wheelchair seating was dispersed sufficiently to provide comparable views. The Plaintiffs in Landis argued that that at least 50 percent of the total accessible seats in Level 100 should be located on the front row and the remaining 50 percent on the back row. The court in Landis determined that the 100 Level should have at least five accessible seats on the front row. the court used a proportionality formula. First, it calculated the total number of accessible seats required in Level 100 which has 18,573 seats using the ADA's 1 percent formula. (See 2010 ADAAG at 221.2.1.1.) Next, it determined that of the 18,573 seats in Level 100, 2.4 percent of them were located on the front row. Finally it determined, of the total number of accessible seats (1 percent of 18,573), how many needed to be located in the front row if those seats were proportionality distributed to the total front row seats. Thus, 1 percent of 18,573 was 186 accessible seats required for Level 100. Of those 186 accessible seats, only 2.4 percent needed to be located on the front row to be in proportion to the total number of front row seats in Level 100.
