Domio was an avid skier. One day, while he was skiing, he lost his balance, and collided into a tree. He had suffered serious head and spinal injury. He was stabilised and airlifted to the nearest hospital, St Barnacle Hospital NHS. Doctor Richard Maverick, the consultant neurologist and Doctor Newton James, consultant orthopaedic surgeon, attended to him.

Despite the seriousness of his injury, Domio was lucid and aware of his surroundings.A computerised tomography (CT ) scan hadbeen performed. However, the full C.T scan report by the radiologist had not been finalized. However, due to the Domio's injuries, Doctor Richard had advised him that he required a surgical thrombectomy to remove clots in his brain. Doctor Richard had failed to advise him that there was 5% risk that during the surgery, the blood clot could move to his lung and he risked death by pulmonary embolism.Domio had full use of his limbs but was suffering from tingling in his upper limbs. Doctor Newton James had advised him that he required spinal fusion surgery.

Due to Domio's condition, both Doctor Richard and Doctor Newton performed their surgery on Domio at the same time. During the surgery by Doctor Newton, he had tighten wires around his C5,C6 and C7. Doctor Richard had removed blood clots in Domio's brain.

A few days later, Domio suffered from pulmonary embolism when a blood clot travelled to his lungs. He suffered from cardiac arrest and was revived by the doctors. Soon after, Doctor Newton noticed that Domio had limited mobility to his legs. He had suffered spFinal cord damage sustained during the surgery.

Advise Domio of his potential claim against Doctor Richard Maverick and Doctor Newton James. Students are to base their advice on cases under the law of England and Wales and how the advice would differ pursuant to cases under the law of Malaysia.
