Donny bought a 1970 classic Mercedes automobile which needed to be restored. And so Donny solicited bids (i.e. offers) for the restoration of his classic Mercedes. Donny received 6 bids from auto restoration shops which ranged from $18,080 to $19,140. A 7th auto restoration shop, Arnie's Auto Restoration ("Arnie"), sent in a bid for $8,100 which was signed and accepted by Donny. Shortly thereafter, however, Arnie sought to rescind the contract because his bid was based on Arnie's computational mistake in computing his bid, which should have been $19,100 and not $8,100. Megan worked at a health club where Megan's immediate supervisor, Ava, constantly and frequently requested of Megan that Megan buy Ava's laptop computer. Megan didn't want or need the laptop computer, but Megan eventually contracted to buy Ava's laptop computer because Megan didn't want to upset Ava, her supervisor. And one day Bob, a health club patron, was injured when he slipped on a puddle of water on the club oor which the health club had negligently allowed to remain on the oor. But when Bob entered the club he received a receipt which stated: "This is a contract which limits our liability. The Club assumes no responsibility for any injury to any patron injured at the Club because of the Club's Negligence." 1. Will Arnie be able to rescind the contract with Donny or is there a binding contract? Discuss. 2. Does Megan have a defense to enforcement of her contract with Ava? If so, discuss. 3. Does the Club have a defense to Bob's lawsuit arising from Bob's injuries caused by the Club's negligence? Discuss
