Dora and Diego separately applied for a loan from Explorer Bank. Upon further perusal of her loan account, Dora noticed that she was being charged PHP 100.00 per month for a miscellaneous fee which did not appear in her disclosure agreement. She complained to Explorer Bank and they explained that the fee is a standard fee applicable to all banks and need not be disclosed. Unconvinced, she led a case in court for violation of the Truth in Lending Act and won. Upon hearing this, Diego also sued the bank for the same violation, him also noticing the same fee was being charged to him without it reflected in the disclosure agreement. He attached the decision of the lower court that handled the case of Dora as evidence of his complaint. Explorer Bank argued that only cases dectded by the Supreme Court has evidentiary value as these are actual interpretations of the law. Can the decision of the lower court be used as evidence in this case? Select the correct response: Yes. There is no outlying prohibition against any evidence used in any case. No. Decisions rendered by lower courts have no evidentiary value when used in a case. Yes, because the Truth in Lending Act said so. Yes. The court's decision in this case can be used as documentary evidence
