Dr. Jack was a successful dentist in Springfield with a profitable practice and over 15 employees, including dental assistants, office staff, and other dentists. In 2019, Dr. Jack hired Jill, a recent graduate of STCC's Dental Hygienist program. Jill is very attractive and she and Jack began flirting in the workplace and subsequently started "sexting" after work. The flirting was consensual and not something Jill objected to. One day, Jack's wife, Mary, discovered a topless photo of Jill in a text message on Jack's phone that Jill had sent him and demanded that Jack fire Jill. In order to save his marriage and keep his wife happy, Dr. Jack fired Jill the next day, telling her that her job performance was great and that he would give her a glowing recommendation when she sought employment elsewhere. When Jill asked why she was being fired, Dr. Jack replied, "Because you are just too good looking. Sorry." Jill immediately consulted with a lawyer about filing a federal lawsuit against Jack for wrongful termination under Title VII of the Civil Rights Act of 1964. Jill /stonely belleves that she was fired because o her sender oling the fist hat her work porformance was custanding. Dr. Jack on the other band willarsuelt court that he didn't fire Jill because of her gender and that 90% of his current employees are female. Instead, Dr. Jack will argue in court that he fired Jill because she was an attractive female who's physical appearance and consenual flirting was threatening to his wife and his marriage. Do you think Jill has a valid claim for discrimination based on sex under Title VII or that Dr. Jack has a valid defense? Explain your reasoning.
