Steve Jones and Mary Brown are friends. Both live in Philadelphia. Steve lives at 1412 Spruce Street. Mary lives at 1742 Tasker Street. Mary asked Steve if he would like to go for a drive on a Saturday afternoon, January 13, 2016. Both Mary and Steve are over the age of 18. Steve accepted and asked Mary to pick him up near his home.
Mary pick up Steve at Broad and Spruce Street in Philadelphia. They drove to the Jersey shore for the day. Steve had plans for later that evening. As they were driving back to Philadelphia, it began to rain. Steve told Mary that he did not want to be late. He asked her to speed up. Mary was a safe driver and told him that she did not feel comfortable going too fast. Steve asked if he could drive the car. Mary said that she did not want anything to happen to her car. Steve assured Mary that he would drive carefully but faster. Mary thought for a few minutes and reluctantly agreed to let Steve drive.
As they were on Route 63, a two-lane road in each direction with shoulders on each side, Steve began to pass a slower vehicle. Suddenly, a truck appeared in the on-coming lane, apparently from a dip in the road that hid the truck from view. The truck was driven by Richard Green of 12 Lonely Lane in Wheatland, New Jersey and was owned by Big Red Trucking from 1212 Kings Boulevard in Queens, New York. The truck was approaching fast. Steve swerved to his left onto the shoulder to try to avoid the oncoming truck. As he did, the truck went to its right, also on the shoulder. Steve swerved back to his right just as the truck hit the driver's side of Mary's car. Mary's car was spun around and slammed into a tree off the shoulder. The side of the car where Mary was sitting hit the tree. Mary was knocked unconscious and suffered a broken pelvis and back injuries. She was taken by ambulance to a hospital where she was admitted for three days for surgery to place pins in her pelvis. She now has pain that runs down the back of her left leg daily. She was told that she will need spinal surgery at some time in the future at a cost of $35,000 to $40,000. Her medical bills to date total $28,000. She used up all her sick leave from work and her vacation time and still lost over $3,000 in wages before she could return to work.
Steve was not as badly injured as Mary. He suffered lacerations to his face and a broken right thumb. He was taken to the hospital ER and released that night. He gets terrible headaches that he claims he never had before the accident. He was unemployed at the time of the accident but was actively looking for employment. He was not able to interview for any jobs due to his headaches for 2 months. When he was able to interview, it took him a long time to find a job because he was a concert musician and he told prospective employers that he could not play well because his thumb still bothered him. His medical bills to date total $11,200.
The Big Red truck overturned in the collision. Richard Green died as a result of his injuries on January 21, 2016. His medical bills totaled $146,000. His funeral bills were $12,000. He left a widow, Sally Green, who was a stay-at-home Mom and three children, Rich Jr., Jane and baby Sally. Sally received $300,000 from Richard's workers compensation carrier. Sally Green returned to full time employment and now earns approximately $10,000 more a year than Richard did at the time of the collision.
For the purpose of Project 2, assume that you work for a personal injury firm and Steve contacted the law firm where you work regarding possible representation. The attorney that you work with has agreed to meet with Steve. He wants you at the meeting and said that he would talk with Steve initially and then would step out so you can conduct Steve's initial interview.
