SCENARIO 1 - The case of the Problematic Pub (Alcohol and Gaming Commission) Our client, Ms. Shannon Kerry, has recently leased a property in a small town in northern Ontario. She opened a family restaurant with an Irish theme. She is seeking to expand the restaurant and turn it into more of a "pub", serving liquor, to appeal to a broader customer base. Her application for a liquor license has been challenged, both by the town and by local residents. Their main concerns surround issues of noise from music, gatherings of customers outside the establishment, squealing tires late at night and drunken behaviour in the streets surrounding the establishment. Our client maintains that these complaints were not against her establishment, but against the bar that was previously located on the premises. The bar was owned by the current property owners who have since closed the business and leased out the property to Ms. Kerry. The town has received only one complaint against Ms. Kerry, when her ex- husband showed up and they had a heated argument. Her husband had to be removed from the premises by local police. The local community's active religious group objects to having Ms. Kerry in the community. They suggest that she's been involved with men several years younger than she is and that this reflects badly on the moral standing of the community. Ms. Kerry denies these allegations and simply says she is trying to get on with her life and run a respectable establishment where local couples and families can gather for good food and entertainment. The firm's job is to satisfy the Alcohol and Gaming Commission that Ms. Kerry deserves the liquor license that she seeks, or, alternatively, to advise Ms. Kerry to give up and take her business elsewhere.
