Each unit, students will identify two key ideas from the Szypszak and/or Svara texts and discuss them in relation to specific sources provided in the module. The key ideas must be from two different chapter readings, and in the weeks where readings from both textbooks are assigned, must represent each text. For each key idea, students will identify the key idea, explain why it is significant to public administration law or ethics, and apply the ideas practically through referencing content from the selected sources identified in the module. ( the chapters) The readings begin with Chapter 9 which addresses torts. The concept of torts is likely a familiar legal concept and relates to the types of damages which can be collected as a result of tort liability. In addition to discussing tort law, the chapter also explores the concept of liability, both for public officials as well as the government by introducing the concept of sovereign immunity. Chapter 10 focuses on criminal law and its constitutional context as well as the procedures that ensure fair treatment and specific protections for both the guilty as well as the innocent.
Chapter 13 reviews the civil dispute resolution procedures including court-enforced litigation and available alternatives. The two most common alternatives for resolving disputes outside of litigation in a court are mediation and arbitration. Finally, Chapter 14 discusses the lawyer-client relationship and explores the responsibilities of lawyers including their obligations to the court, other lawyers, and their clients.
This week's activities include our weekly discussion as well as the third, and final case analysis. As a reminder, the resources students should utilize to research additional cases for the case analysis are still available in the Week 2 Lecture.
