Eastpac Bank leased premises on the bottom floor of a four storey building in Zenith, New South Wales. The six year lease, which is registered under the Real Property Act 1900 (NSW), provided that employees and customers of Eastpac Bank could use the main entrance on the bottom floor to access the building. The lease also provided that employees and customers could use the rear car park. Six months into the lease the landlord decided to renovate the building. The renovations created noise, chemical smells, dust, and intermittent loss of electrical power during business hours. Construction equipment was stored in the rear car park which made it inaccessible. Some of Eastpac Bank's employees suffered from migraines due to the chemical smells and loud noises. Customer attendance at the branch decreased substantially after the commencement of the renovations. Three months into the renovation the landlord decided to change the locks on the main entrance for security purposes. Consequently, Eastpac Bank employees could not access or exit the building via the main entrance outside of business hours.
