Heading 2 BIE When determining whether a risk was willingly assumed by a plaintiff, the court will have to assess whether the plaintiff had sufficient knowledge about the risk in question. If the plaintiff knew about the risk before it happened, then the court will have no other reason not to declare plaintiff assumed the risk in question. If the plaintiff was not aware of the risking question occurring, then it goes without saying that the plaintiff did not willingly assume the risk. The other factor that the court will look into is whether the plaintiff accepted the risk in question voluntarily. In order to do this, the court will assess the actions and word of the plaintiff. If the plaintiff acted in a manner that showed they were aware of the risk or they uttered words that suggested the same, then the court will rule that the risk in question was willingly assumed by the plaintiff.
