EITHER Problem Question Elle went to see Dr Chen her GP in March 2019 for a routine smear test. Dr Chen sends Elle's sample off for analysis to Dr Abe who is the primary screener in the Cytology Department at Wellville NHS Trust. Dr Abe examines the sample and concludes that it is negative. In fact the sample contained cells that were cancerous. Elle has now developed invasive cervical cancer and her prognosis is that she has a 30% chance of surviving the next five years. Medical evidence shows that if the abnormal cells were detected in 2019 there would have been a 51% chance of her making a full recovery. Advise Elle on (i) whether there has been a breach of duty by Dr Chen and/or Dr Abe and (ii) if causation can be established
