Ella, a builder, contracts with a developer to build an apartment complex consisting of twelve units. She subcontracts the flooring to Jade for a total price of 85,000. Jade agrees to complete the job within 6 months.

After 4 months, it becomes clear that Jade has fallen behind with the work and this is due to her inexperience in supervising her workers. She tells Ella that she will not be able to complete on time and might not be able to finish it at all unless Ella pays her some extra money.

Ella is receiving pressure from the developer to complete the project as quickly as possible because the property market has improved dramatically following the lifting of Covid-19 restrictions. She tries to find another flooring contractor to replace Jade, but given the improved economic conditions, flooring contractors are in limited supply and will charge much more for the job.

As a result, Ella agrees to pay an additional 15,000 to Jade if the work is completed within the original deadline.

While Jade works to complete the flooring, Ella is keen to see if she can speed up the work even further. She decides to get in touch by email with Jason, a flooring contractor she used a few years ago for another similar project, to see if he could take over the flooring work for four of the remaining apartments.

Ella's email to Jason at 11.30 am says that she will offer him 25,000 for the work. Jason replies at 12.30 pm, 'OK, happy to help out a friend.' Jason's email is held up by a malfunction at the service provider, with the result that it does not reach Ella until 3.00 pm. At 1.00 pm, Ella has a change of heart and emails Jason seeking to revoke her offer with immediate effect. Jason reads Ella's email seeking to revoke the offer at 1.30 pm.

In the meantime, Jade completes all remaining work within the original deadline but Ella has now changed her mind and will only pay her 85,000.

Are Ella's promises to pay Jade, an additional 15,000 and Jason, 25,000, enforceable?
