Ellen takes her Chanel black dress and jacket to No Worries Drycleaners Pty Ltd. She gives the shop assistant the dress and jacket. Ellen pays $60 for the dry cleaning service. On the cash register is a large black and white sign that states "All care, no responsibility". Prior to giving her the receipt, the shop assistant tells Ellen she must bring the receipt back to collect her clothing.
When Ellen arrives to collect her clothing she notices that the colour of the dress and the jacket has changed from black to grey. Furthermore, the buttons on the jacket have melted and there is a rip in her dress. Also in the bundle of clothes is a pair of green trousers that are not hers. She brings all these things to the attention of the shop assistant, who points to the back of the receipt. It states "All care taken. No responsibility for damage caused in the removal of stains during cleaning."
Applying the law of contract, and with reference to cases, discuss whether:
a. the sign on the cash register is an enforceable term of the contract;
b. the statement on the back of the receipt is an enforceable term of the contract; and
c. No Worries Drycleaners Pty Ltd is liable to Ellen.
