Elmer is the owner of D+ Crushing and Recycling, Inc., a trucking company. One day, the brakes on one of his trucks fail while it is descending a hill in Bristol, Connecticut. Out of control, the truck crashes into a line of vehicles at the bottom of the hill as they wait at a stoplight, including a transit bus owned by Keeney Transportation, LLC. Several people in cars and on the bus are injured, some fatally. During the ensuing court case, lawyers for Keeney review D+'s bank statements. They notice that Elmer has written several $5,000 checks for vacations and other personal uses fromD+'s main operating account. They further discover that D+'s only assets are its trucks, which are in extreme disrepair. Elmer, however, is very wealthyand has significant personal assets. What should the Keeney lawyers ask the judge to do relative to Elmer's handling of D+'s corporate funds? Will they be successful?
