Elodie has also ordered Brut champagne and other beverages from Roderick's Wine Company (RWC). On the morning of the wedding PCC's premises experience a failure of electrical power supply which is not remedied until after 2pm, which is the time that PCC is supposed to deliver the foodstuffs for the wedding reception. Peter rings Elodie and says, 'I can't deliver the goods I'm sorry but it's not my fault we had no electricity and I couldn't prepare the food and wedding cake.' RWC delivers beverages and champagne at the appointed time but the champagne is Everyday Brand which is much cheaper than, and inferior to, Brut champagne. When Elodie asked why Brut champagne had not been delivered the delivery man said, 'I don't know but you should be happy this stuff is far less costly.' Elodie is furious that Anna's wedding reception 'was ruined by the incompetence of PCC and RWC.' She wants to sue both companies for failing to fulfil their contractual obligations. a) Advise Elodie of the contractual remedies available to her. b) Are any defences available to PCC and RWC? c) Would your answer differ if Elodie had been able to make emergency arrangements for the supply of foodstuffs, including a wedding cake, and Brut champagne?
