EMPLOYMENT AND INDUSTRIAL RELATION LAW (GLUE 2033)

Prem is the owner of Petronis petrol station located in Jitra, Kedah. Last April, Prem conducted an electronic system maintenance at his petrol station to make sure that it is safe. Prem appointed Cosmic Electrical (CE) to carry out the maintenance. CE advised Prem to stop the operation of the petrol station for a week to allow them to carry out the maintenance work safely. Prem, however, disagree with the advice and instructed his employees to work as usual. Throughout the electronic maintenance process, there were a lot of exposed hardware and electrical wires around the petrol station.

1. Shima, Prem's employees, accidentally grabbed an electrical wire while cleaning the petrol station's compound causing her struck by the electric shock;

2. Wong, the driver of Petronis oil tanker was struck with fire spark coming from the tools used by CE while he was delivering oil supply; and

3. Azwan, Prem's employee, was seen smoking near the NGV tank store at the back of the petrol station.
