You have been asked to draft an employment contract for a Public Relations Manager role at RASA Solutions (hereinafter "RASA"), an Ontario company which provides temp workers to clients. This type of business is subject to provincial regulations.
RASA has interviewed several candidates and wishes to present an offer of employment to Brian Yu. It is anticipated that Brian would commence with RASA in their corporate headquarters on June 22, 2021. RASA wants Brian to present a positive image of the company, both in traditional and digital media.
RASA is very concerned that its proprietary interests be protected.In other words, Brian should not be able to remove any company information or contact any clients of the company. A few years ago, an employee left and immediately used company information to poach existing clients of RASA. It cost RASA a lot of money in lost revenue. RASA wants to do everything possible to avoid a similar situation in the future.
RASA will provide compensation as follows:
-a base salary of $104,000 per year
-eligibility in a profit sharing plan that will pay Brian a 15% bonus if RASA profit exceeds $6 million dollars in the Fiscal year
-car allowance of $600 per month, no receipts are required
-an IT allowance of up to $1500 per year, which will permit Brian to purchase laptops, software and other IT materials for his home office. Receipts are required
-a learning allowance of up to $1500 per year, which will permit Brian to attend seminars, training and other educational programming related to his field. Receipts are required and prior approval of these seminars, training and programming is also required.
-five weeks of vacation after 12 months of employment and vacation pay of 10%
-there is no pension or retirement plan
Brian will be expected to:
-work a minimum of 44 hours per week plus overtime as needed and as permitted under the ESA
-manage all traditional and digital media contacts
Should it be necessary to terminate Brian's employment (without cause), RASA will provide three weeks in lieu of notice for every year he is employed by RASA.
