Energy Inc ("EI"), an Ontario Corporation, was hit hard by the energy slump since the beginning of the supply chain disruptions that occurred since the conflict in the Ukraine. It was however, doing everything it could to maintain employees on staff. All staff have employment contracts that mention the Employment Standards Act. It recently became aware of an employee who criticized EI on social media with the employee saying that "EI did not care about its employees, because they don't bother to fight for us and treat us all like trash. They even cancelled our employee dinner and are firing everyone. Stay away from this company". The facts of the employee dinner being cancelled is true, but the expression that EI does not care is mere opinion. The upset employee has been with the company for 3 years. The CEO of EI is livid and she feels that they have made every effort to keep employees on the job during a challenging time. She wants to fire the employee who made the remarks online.
Explain the options for terminating the employee and what the CEO will need to keep in mind in making any decision. What would you recommend the CEO do in light of what you've learned in this course? What risks are there associated with your proposal?
